Discriminatory and threatening and unsafe conduct from staff. The manager told us to "F*** off" when he said he would sit us and then changed his mind. The host then proceeded to call me pathetic and miserable and then they called the police on us. The general manager then threatened physical force to remove us. We explained to the police what happened. The police agreed that it was bad customer service on the part of the restaurant but that the level of cursing and threats didn't rise to physical criminal threats under Cal. Penal Code 422. I didn't agree that it wasn't physically threatening. The backstory is that my friends and I, from out of town, tried to get a seat at the Misfit on a Friday night. Both are from the inner City, and I wanted them to have a nice meal. I had problems arranging with their Yelp seating. We can at 11:30, they're last call, but the host said we came at 11:35. Really; it appears that the host didn't want to sit us because he wanted to go home. (Instead, he should have been focused on the reputation and service of the restaurant and the way he is representing the owner and founder of the place.) The manager agreed to sit us for appetizers, but for some reason, after talking to the tired host, the manager then changed his mind. Two of my friends were young Hispanic guys, and I'm a minority myself. The two that were cursing and yelling at us were both white males. We believe we were discriminated against. It's clear the guy who cussed at us, threatened us physically, and called the police has anger issues and self-control issues. It's my view he really shouldn't be in charge of managing people. I called the restaurant the next day to complain. The manager said she'd call me back in an hour and never did. I emailed the management team and heard nothing as well. I also called their corporate office to leave a message. I'm very disappointed in how this restaurant treated us. I'm disappointed that the management team never addressed our concerns. All they had to tell us, if they were really unable to sit us, is that they were sorry we drove so far and that they would make it up to us by making sure we had a seat next time for sure. They really get an "F" for customer service, an "F" for racial sensitivity, and an "F" for friendliness and kindness and commonsense. In times like these, with the pandemic and racial tensions, management in fine dining establishment have to learn not to behave themselves so discriminatory and unprofessionally.
